Types of Spousal Support Available Under Tennessee Law
When the courts have to make an order for spousal support, they consider the financial needs of each spouse as well as the financial ability of each spouse to meet those needs.
The different types of spousal support available in Tennessee are provided for in TN Code ยง 36-5-121 (2021). A court may award:
- Rehabilitative alimony – rehabilitative alimony is awarded to help a disadvantaged spouse achieve, with reasonable effort, an earning capacity that can afford them a standard of living comparable to what they enjoyed while they were married.
- Alimony in futuro (also known as periodic alimony) – when rehabilitative alimony will not achieve its desired effect, the court may award alimony in futuro, which is a long-term payment that continues until the death or remarriage of the economically disadvantaged spouse.
- Transitional alimony – transitional alimony is a temporary award to assist the economically disadvantaged spouse in adjusting to the economic consequences of the divorce or legal separation.
- Alimony in solido (also known as lump sum alimony) – alimony in solido is a lump sum calculated to provide financial support to the economically disadvantaged spouse. It may be ordered to be paid in installments over a definite period of time.
While the court may award any one of these types of spousal support, the court may award an order that is a combination of these different types of spousal support.
